Session Abstract: FERPA, the main data privacy law for U.S. higher education, dates to the days of paper records, and FERPA guidance from the U.S. Department of Education still lags behind technology. Nonetheless, USDE compliance guidance establishes principles that are reliable guides to using AI for institutional research while respecting students' privacy rights. The session reviews the history of federal policy statements, technical assistance, and complaint findings on FERPA, identifying best practices for moving forward with cutting-edge technology and paper-record policy.
